PAIA Manual

This manual is published by Sjarmant Watches (Pty) Ltd, trading as Livia Karsten, in terms of section 51 of the Promotion of Access to Information Act, 2 of 2000 (“PAIA”).
PAIA entitles any person to request access to records held by a private body, subject to the grounds for refusal the Act sets out. This manual says what records we hold and how to ask for one.

B. The SAHRC guide to using PAIA
The South African Human Rights Commission publishes a guide, required by section 10 of PAIA, explaining how to exercise your rights under the Act — how to lodge a request, what it costs, and what to do if a request is refused. It is available from the Commission in all official languages, at www.sahrc.org.za.
C. Records available without a formal request
Some information is published and needs no PAIA request at all:
- The shop itself — products, prices, availability, at www.liviakarsten.co.za
- This manual, and our Privacy Policy and Terms and Conditions of Sale
- Your own order — the confirmation email we sent you is a copy of the record we hold, and you may simply ask us for another
D. Categories of records held
Sjarmant Watches (Pty) Ltd operates one online shop. The records it holds fall into these categories:
Customer and order records:Name, email address, delivery address, optional phone number, any note left at checkout, the items ordered, the amounts, the payment reference and status, and the dispatch status.
Product and catalogue records:Descriptions, photographs, prices, sale prices, stock levels and collection groupings. No personal information.
Payment records:Payment references and confirmations received from PayFast. Card numbers are never received or held by us.
Correspondence:Emails to and from customers about orders, deliveries, returns and enquiries.
Administrative and security records:A record of changes made in the shop's admin, sign-in attempts to it, and the devices registered to sign in. These concern the business's own staff, not customers.
Company records:Statutory, financial, tax and accounting records required to run a company in South Africa.
Records containing personal information are described in more detail in our Privacy Policy, which also names every service provider that processes them.
E. Records held under other legislation
Records are also kept as required by, among others, the Companies Act 71 of 2008, the Tax Administration Act 28 of 2011, the Income Tax Act 58 of 1962, the Consumer Protection Act 68 of 2008, and the Protection of Personal Information Act 4 of 2013.
F. How to request access to a record
A request must be made as follows:
- Complete the prescribed PAIA request form (Form 2 under the PAIA Regulations), available from the Information Regulator’s website.
- Send it to the Information Officer through the form on this page. A postal address for posting a completed Form 2 will be given on request.
- Describe the record clearly enough for us to find it, say which right you are seeking to exercise or protect and how the record will help, and give us a contact address.
- Include proof of identity. If you are asking on someone else’s behalf, include proof of your authority.
- Pay the request fee and any access fee prescribed by the PAIA Regulations. We will tell you what is payable before doing the work, and a requester asking for their own personal information pays no request fee.
We will decide within 30 days, as PAIA requires, and tell you the outcome in writing. That period may be extended by a further 30 days where the request is for a large number of records or requires a search through records held elsewhere; if we extend it, we will tell you why.
A request may only be refused on a ground PAIA allows — most commonly the protection of someone else’s personal information, commercial information of a third party, or records privileged in legal proceedings. Any refusal will state the reasons and set out the remedies open to you.
G. Requests about your own personal information
If all you want is your own information — what we hold, a copy of it, a correction, or its deletion — you do not need a PAIA form. Use the form on this page and we will deal with it under POPIA, as described in the Privacy Policy. It is the faster route and it is free.
Write to us
You can use the form rather than email if you prefer — it reaches the same place, and it means the address does not have to sit on the page for a robot to collect.
H. Complaints and the Information Regulator
If you are unhappy with the outcome of a request, or with how we have handled your personal information, you may complain to the Regulator:
