Terms and Conditions of Sale

These terms govern every purchase made on www.liviakarsten.co.za. Please read them before you order — placing an order means you accept them.
They set out what you are buying, what it costs, when it arrives, and how to send it back. Where South African law already gives you a right, these terms state that right rather than trying to reduce it.

Prices
All prices are shown in South African Rand (ZAR) and are the price you pay for the item. No VAT is added, because the company is not registered for VAT. Delivery is shown separately at checkout before you pay.
Prices can change, and an item can go on sale or come off sale. The price that applies to your order is the price shown when you check out, which is calculated by our system rather than carried from the page you were looking at.
Obvious pricing mistakes. If an item is listed at a price that is clearly wrong — a watch at R45 rather than R4 500 — we are not obliged to sell it at that price. We will tell you, cancel the order and refund you in full. You are free to reorder at the correct price. This reflects section 23(9) of the Consumer Protection Act.
Placing an order
Adding something to your cart and checking out is an offer to buy. The sale is concluded when we confirm your payment, which is when you receive our order confirmation email. Until then no contract exists and either of us may walk away.
Before you pay, the checkout page shows every item, the quantity, the delivery cost and the total, and you can go back and change any of it. If you spot a mistake after ordering, tell us using the form below as soon as you can and we will correct it if the parcel has not gone.
The watches are made by hand and stock is limited. If something sells out between your order and our packing it, we will contact you and refund that item in full.
Payment
Payment is taken by PayFast, a licensed South African payment gateway. You can pay by credit or debit card, Instant EFT, or the other methods PayFast offers at the time.
Your card details never reach this website.You are handed to PayFast’s own secure page to pay, and they tell us only whether the payment succeeded. We never see, hold or store your card number.
Nothing is dispatched until payment has cleared.
Delivery
Orders placed through this website are delivered anywhere in South Africa.
Delivery within South Africa is free. It is included in the price you see, so there is no delivery charge on any order, anywhere in the country, and nothing is added at the end.
How long it takes: 5 to 10 business days from your payment clearing.
Most pieces are not sitting on a shelf. A watch is assembled and then tested once you order it, and that is deliberate — it is where the extra few days go, and it is why what arrives has been checked rather than picked. We would rather take a week than send you something nobody has looked at.
The window is a target and not a guarantee: a courier delay, a public holiday or a remote address can push it out. If your order is going to be materially later than this, we will tell you rather than leave you waiting.
Outside South Africa. We hold an export licence and we do ship abroad, but not through this checkout — international carriage costs depend on where it is going and how quickly you want it, so it has to be quoted. Write to us using the form below with the country and the piece you want, and we will come back with a price and a delivery time before you commit to anything.
Your address. We deliver to the address you give us at checkout. Please check it. If a parcel goes astray because the address was wrong or incomplete, we will help you trace it, but we cannot carry the cost of a redelivery.
Risk. The goods are at our risk until they are delivered to you or to somebody at your address, and at your risk from that point on. This follows section 19 of the Consumer Protection Act.
If nothing arrives. If your order has not reached you within 15 business days, email us and we will find it or replace it. You may also cancel and be refunded in full.
Cancelling an order
Before it ships. Tell us and we will cancel it and refund you in full. Because a piece is often being built for you, the sooner you say the better.
After it arrives — 21 days, no reason needed. You may cancel and send it back for any reason at all within 21 days of receiving it. You do not have to explain yourself and there is no penalty. The only cost you carry is the postage back to us.
That is deliberately longer than the law requires — section 44 of the Electronic Communications and Transactions Act sets the floor at seven days — because we would rather you had time to live with a piece than hurry a decision about it.
We refund within 30 days of cancellation at the outside, and in practice within a few working days of the piece reaching us.
A returned item must be in the condition it reached you in: unworn, with its packaging. A watch that has been worn or a bag that has been used cannot come back as a change of mind — although that has no bearing at all on your rights if it is faulty, which are set out next.
One exception, and it is narrow. If you ask us to build a combination that is not on the site — your own pairing of case, dial and strap — that piece is made to your specification and the cooling-off right does not apply to it, under section 42(2) of the ECT Act. That exception is about pieces designed by you. It does not cover the ordinary catalogue watches, which are assembled after you order simply because we do not hold them in stock: those you may return like anything else.
Faulty, damaged or wrong items
If something arrives broken, faulty, or is not what you ordered, we make it right. Email us within a few days of it arriving, with a photograph if you can, and we pay the return postage.
Separately, section 56 of the Consumer Protection Act gives you 6 months from delivery to return anything that turns out to be defective or of poor quality. Within that window the choice is yours, not ours — a repair, a replacement, or a refund — and it is done at our cost.
This does not cover ordinary wear, accidental damage, or a strap or battery reaching the end of its natural life.
Refunds
Once we have your return, or once we agree to cancel:
- The refund goes back to the way you paid, through PayFast, to the same card or account. We cannot refund to a different card.
- We aim to process it within a few business days, and are bound to do it within 30 days. Your bank may take a further few days to show it.
- A change-of-mind refund covers what you paid for the item. Your own cost of posting it back is not refunded.
- A refund for a faulty, damaged or incorrect item covers everything, including what it cost you to send it back.
How to return something
Use the form above with your order number — it begins LK- and is on your confirmation email — and tell us what you are returning and why. We will reply with the return address and confirm who is paying the postage.
Please do not send anything back before you hear from us. Use a service that can be tracked: until a change-of-mind return reaches us, it is at your risk.
Your privacy
We collect your name, email address, delivery address and, if you give it, your phone number, so that we can send you what you bought. What we do with it, who else touches it, and how to have it deleted are set out in our Privacy Policy.
Write to us
You can use the form rather than email if you prefer — it reaches the same place, and it means the address does not have to sit on the page for a robot to collect.

Tell us first, using the form above. using the form above. Most things are a misunderstanding and are fixed the same week.

The rest
Governing law. These terms are governed by South African law, and the courts of South Africa have jurisdiction.
Your statutory rights stand. Nothing in these terms limits or replaces any right the Consumer Protection Act or the Electronic Communications and Transactions Act gives you. If any term here conflicts with those Acts, the Act wins and the rest of these terms carry on.
Changes. We may update these terms. The version that applies to your order is the one published when you placed it, and the date at the top of this page tells you when it last changed.
Images and descriptions. The watches are made by hand and no two are identical, so small variations in colour, grain and finish are part of what you are buying rather than a defect. Photographs are taken as faithfully as we can manage, but screens differ.
